Website User Agreement for Kent Car Collection

Nothing contained in these terms and conditions will affect a consumers statutory rights under The Sale of Goods Act 1979 or The Unfair Terms in Consumer Contracts Regulations 1999.

General

You must agree that you will not make a claim for damages as a result from using this website. Kent Car Collection operates to the highest standards and do not believe that using this website can cause loss or damage to your PC.

By accessing or using the site, you agree to be bound by the terms and conditions set forth below. If you do not wish to be bound by these terms and conditions, please exit this site immediately. Kent Car Collection may modify this agreement at any time, and such modifications shall be effective immediately. You agree to review the agreement periodically to be aware of such modifications and your continued access or use of the site shall be deemed your conclusive acceptance of the modified agreement.

Website and images

Kent Car Collection and/or any other names belonging to Kent Car Collection group of companies, or it’s website are the exclusive copyright of Kent Car Collection, including the "look" and "feel" of the website, colour combinations and layout. Any use of Kent Car Collection images is strictly prohibited without the expressed permission from Kent Car Collection. Other product and company names mentioned in the website may be the trademarks of their respective owners.

Car Storage

You must make sure that your vehicle is covered for fire, theft and accidental damage.

Subject to the rules contained in the Unfair Contracts Terms Act 1977. It is a condition under which a vehicle is accepted for storage that, the customer relieves Kent Car Collection of all liability for loss or damage to customers' vehicles or contents thereof, however caused. All customers are therefore respectfully notified that we do not accept responsibility for loss or damage to any vehicle accessories or other goods while in our hands for any purpose arising from any cause. This condition extends to customers' vehicles while being driven or moved by members of our staff, or while standing inside or outside our premises. The customer agrees to indemnify Kent Car Collection against any claims arising from the storage of their vehicle.

Kent Car Collection may refuse to deliver goods or release a vehicle if charges owed by the depositor have not been paid. Kent Car Collection shall be entitled to exercise a lien over the goods or vehicle for any such unpaid charges. In the case of any such lien not being satisfied within two weeks from the date upon which Kent Car Collection first gave notice to the depositor, the goods or vehicle may be sold and the proceeds of the sale applied first in or towards meeting all of the charges due to the company. In the case of late payment Kent Car Collection is entitled to charge interest on any unpaid debts owing at the rate of 8% over the UK base rate per month or part thereof from the due date.

Notice

We will require at least one week's notice to remove a car from storage. We aim to be as flexible as possible provided we have reasonable notice especially if servicing and MOTs are required.

The minimum storage period is one month.

Payments

All payments for vehicle storage is to be paid monthly by Standing Order, or by invoice quarterly in advance in Sterling or most major currencies. Minimum storage period is one month.

Non Payment

Please note that all goods and services will be secured against the value of the vehicle under contract in storage, and remain the property of Kent Car Collection until paid for in full.

Car Sales

Warranty

ALL VEHICLES ARE SOLD AS SEEN AND WITHOUT WARRANTY UNLESS OTHERWISE STATED.

Vehicles are supplied in the condition as stated in the vehicle listing and subject to any conditions or warranties that are implied by the Sale of Goods Act 1979 or any amended statute in the case of the consumer sales (as defined by the Sale of Goods Act 1979 as amended).

Kent Car Collection can not guarantee the time of delivery and shall not be liable for any damages or claims of any kind in respect of delay.

If a contract is in place, but then cancelled by the buyer, any deposits shall be retained by Kent Car Collection. The sum retained will need to be sufficient to cover the losses Kent Car Collection are likely to incur.

Vehicles remain the property of Kent Car Collection until the total purchase price has been paid in full.

Refunds

If for any reason your item is not delivered to the highest standards please contact us. We will do our best to resolve any problems or issues that arise.

Delivery

Please allow 3 - 5 days for delivery. All items purchased from Kent Car Collection are packed to the highest standards and we give 100% attention to the way our items are shipped.

Items damaged in transit must be returned within 28 days for a refund to be considered. We will refund any payments made if for any reason your item does not reach you in perfect condition.

Customer information

We take customer privacy seriously and DO NOT share customer information. The information you give us is not traded or sold on to other companies.

This site does NOT store credit card information.

Dealings with Third Parties

Your participation, correspondence or business dealings with any third party found on or through the website, regarding the payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such third party. You agree that Kent Car Collection shall not be responsible or liable for any loss, damage or other matters of any sort incurred as the result of any such dealings.

Because Kent Car Collection has no control over such websites and resources, you acknowledge and agree that Kent Car Collection is not responsible for the quality of service or products provided by these companies. Kent Car Collection is not liable for the accuracy of any content, banner, advertising or listing from such websites or resources. You further acknowledge and agree that Kent Car Collection shall not be responsible or liable, directly or indirectly, for any damage or loss caused by using linked third party services and any issues with such third party services should be dealt with those companies directly.
